According to a news article posted by Bilyonaryo, TVJ or Tito, Vic, and Joey, together with their creative genius Jenny Ferre, scored another massive win in their high-profile legal battle against GMA Network Inc. of Mr.Felipe Gozon, and TAPE Inc of the Jalosjos family.
The Court of Appeals Ninth Division recently upheld a Regional Trial Court (RTC) ruling that permanently enjoined GMA Network Inc. and TAPE Inc. from using the "Eat Bulaga" and "EB" trademarks without the consent of its rightful owners, TVJ and Ferre.
The Court of Appeals (CA) affirmed that the Marikina RTC Branch 273 “did not err” in any of it's rulings favoring TVJ and Ferre in their case against TAPE Inc. and GMA Network.
The key rulings upheld by the CA includes:
* Holding TAPE Inc. liable for unfair competition and copyright infringement.
* Enjoining TAPE and GMA from using the “Eat Bulaga” and “EB” trademarks, including all associated logos, jingles, songs, and recorded episodes, segments, or portions of “Eat Bulaga” prior to May 31, 2023, the date when TVJ, their creative team, and talents departed from TAPE and GMA.
* Directing the Intellectual Property Office of the Philippines (IPOPHL) to cancel TAPE’s trademark registrations for “Eat Bulaga,” “EB,” and their corresponding logos.
“The exclusive right of scientists, inventors, as well as artists and gifted citizens – like respondents Tito, Vic, and Joey and Jeny here – over their intellectual property and creations, must be protected and secured,” the CA said.
“Awareness of, and compliance with, intellectual property laws is certainly the obligation of all persons, natural or juridical. To attain the advantages provided by society’s scientists, inventors, artists, and other gifted citizens, there must be respect for and enforcement of their rights and one way to carry this through is to guard against unauthorized trespass,” the CA added.
